Health Care Power of Attorney (HCPOA)

The Arizona Health Care Power of Attorney instrument helps protect YOU!

That makes it extremely important don't you think?

This modern legal tool helps others make certain medical procedures for you when you aren't able to make them. It grants permission to your agent to act in your behalf to consider elective health care treatments, procedures or surgeries. This is a power you grant only when you are not able to act yourself.  (It takes over automatically and you can revoke it's power as soon as you recover)

If you are married, most would name their spouse for this duty. If you are single -- you can name whoever you trust the most to take over your health care decisions for you. But, again, remember you are putting your life or future well being in the hands of another -- so choose wisely.  You wouldn't want to give those powers to just anyone would you?

You don' t need to worry about emergency procedures to save or preserve your life. They will be provided to you in most cases without this instrument. The problem lies in the elective treatments, those procedures or surgeries the doctor or hospital recommends that are not dire emergencies. Before they can perform these health care services, they will need your "John Henry" on their release forms before they will proceed. If you can't sign, this document allows your agent to sign instead.

Mental Health Care Power of Attorney (MHCPOA)

The newest health care document to enter our estate planning portfolio is the Mental Health Care Power of Attorney form. There is just one purpose: to preplan procedures and assign agents in charge -- in case your mental capacity falls below the legally acceptable criteria here in Arizona. Yes, there is some leeway for "senioritis" and temporary memory loss episodes. This form helps your loved ones to help you better if were ever to be considered "mentally ill" or "mentally incapacitated". 

Without going into the specific tests that mental health care workers use to determine mental illness, suffice it so say that mental incapacity in any form can be devastating on a family member. But, with a MHCPOA, you can pre-plan your care and who choose who cares for you if you ever fall into this area of health care that so many fear. (throw away those aluminum pans!)   You can be ready if a mental deterioration illness does take place in your future.

Arizona Living Will (ALW)

The modern Arizona Living Will contained in our Trust Portfolios protects against the situation of becoming terminally ill, or maybe even worse -- incurring significant mental incapacity in an otherwise healthy body. 

We all could find ourselves in harms way in this manner and thus be caught in a coma we may never wake up from. General Durable Power of Attorney (GDPOA)

The Arizona Durable General Power of Attorney instrument is a "money care" document.  It helps protect your money when you aren't able to make good, sound mental financial decisions.  If you are married, most would name their spouse for this duty. If you are single, you can name a child, relative, advisor or friend to serve.  

But, remember this will result in the same procedure as handing your checkbook, debit card or credit cards to someone else and asking them to pay the bills and manage your money for you.  Of course, they are only "empowered" during the time you are disabled or unable to function mentally. You DO want to be cautious who you name as your agent for this document. You DON'T want to give these powers to just anyone unless you know they can do a good job for you.

What most don't understand is that this is one of the most important legal documents you can possess in the state of Arizona!  Without it, things can get out of control and expensive, very, very quickly!  You see if the court is made aware of your disability (financial institutions and their staff are required to report suspicious activity under the law), the control you so commonly assume you have when you are well is instantly transferred away from you under Arizona statutes!

Pour Over - Last Will & Testament  (POLWT) 

The Pour Over Last Will & Testament we use with a modern Arizona living trust portfolio is in the same format as any other Last Will. The main difference is that the instrument is normally just a few pages, since almost all of the terms and conditions relating to your estate are contained in your trust document. In other words, the assets the Will will actually control in most cases, will be only very small bank accounts or low valued personal property such as an older car, etc.

Being careful not to exceed the Arizona $50,000 limit on personal property and $75,000 limit on real (your real estate) property, some chose to keep lower valued assets out of trust until death. At your death, anything kept out of the trust upon will "pour-in" at your death with this instrument, even if your estate is still required to go through probate. (which means either your financial advisor or you didn't properly fund your trust)

The POLWT also has a few other purposes beyond being a safety net for the trust estate that get legal in nature. You can rest assured that it is an important and necessary document that belongs in your trust portfolio.

U.S. citizens are concerned about the financial crisis we have in our country. They can easily see by watching evening news stories, what is happening abroad could easily happen here. Some feel, sooner or later, a financial storm is going to blow into this country.  With the increase in food prices obvious now, and knowing it will be exacerbated more by lost crop production due to the floods and storms the country has recently experienced. 

One thing is for sure. Printing paper money with nothing to back it up and monetizing the debt in this way will only result in the same negative results as countries that have tried it in the past. All have failed. There aren't any success stories!  They say insanity is defined as "repeating the same pattern over and over and expecting different results."

Just like writing checks in your bank account and exceeding the limits of your bank balance would not result favorably for you, nothing is different when the U.S. government basically does the very same thing.

You can hide your head in the sand and ignore this important development which many feel is beyond the point of no return (because they keep spending more than they take in). The current national debt service alone is a challenge just to pay interest only -- and may soon become impossible.

When  "defaults" on U.S. debts and obligations take place,(remember the full faith and credit statement?) there will be a run on banks and insurance companies like you have never seen in your lifetime. It will exceed anything from the great depression because the U.S. population and financial numbers are so much larger than anytime in the past history of our country!

Question: Will another financial crisis similar to the 2008 crisis happen again?

Our firm can not say for sure as no one knows for sure what the future holds.

Question: Can I be prepared, just in case it does?

Yes you can. And converting some of your estate assets into physical gold (and other precious metals) can help offset a fast declining dollar. Devaluation of paper money happens when a country wrongly chooses to monetize it's debt and print money foolishly with nothing to back it up. The end result could leave you with very little purchasing power during an economic Tsunami. Some say one is already heading our way...

You can also convert paper dollars into real property (physical ownership of  real estate such as bare lots, farm land, rental properties, etc.) so that your values do not depreciate as much as leaving them in paper currency. Our firm can again assist in that area.
