Trust Portfolio Profile and Overview

FSI Order PageWe proudly present this new profile page to help you learn more about the individual documents contained in our popular Legacy Trust Portfolio

Here, you can discover important information about each document and why they are included in our popular "Legacy Trust" portfolio series.

You can also fill in any gaps in your present trust or estate planning system and order our individual quality estate planning legal documents as needed to help assure your heirs everything will be up to date. Our updated documents can replace any documents you currently have that may have grown out of date with recent law changes. Or perhaps your current documents are in need of correction for name changes, divorce or deaths in the family, beneficiary percentage changes, etc.

Also, it would be wise to consider updates if your current estate planning documents have not been updated in many years. Or, if you have recently moved to Arizona and brought in your legal documents prepared in another state. We are a minority state with our "community property" law and failing to understand or draft proper community law in updated legal documents could cause a "mis-fire" later. You don't want to ignore it if you are married and later divorce, or lose a spouse after your residency is established here in Arizona.

Of course, any other changes in your life or lives are also good reasons to review all legal documents you now have. This will help assure they say exactly what you want them to say when you are no longer able to communicate your wishes in cases of disability or upon your eventual demise.

If you don't have any documents or your documents are "spotty" and missing certain instruments commonly used to complete a "full coverage" package, this is a good place to start to read about our individual Arizona estate planning documents. You can better understand their purpose, cost and then decide if you would like any particular document in your current estate planning portfolio.

However, if  you are here reading about Living Trust Portfolio legal documents and your net estate assets are below $100,000 or if your assets aren't much higher than this limit (Arizona probate is triggered on real estate for an individual if value exceeds this amount) it may be wise to review our popular "Legacy Will Portfolio" which has all of the same individual documents as our Trust Portfolio, but comes instead with a quality and custom drafted "LAST WILL" instead of a Living Trust. Pricing is about 1/2 for a Will portfolio.

Living Trust (Stand Alone Trust Only)

Our single person trust is over 40 pages long and our marital trusts are now over 50 pages.  If you have a thin trust, or are price shopping -- be sure to ask how many pages you are going to get.  Having a larger estate (over $500,000) and trying to protect it with a thin or cheap trust is like packing a custom van full of people and suitcases and going on vacation with tiny little cheap or worn down tires on the rims.

Health Care Power of Attorney (HCPOA)

Health Care Power of Attorney

The Arizona Health Care Power of Attorney instrument helps protect YOU!

That makes it extremely important don't you think?

This modern legal tool helps others make certain medical procedures for you when you aren't able to make them. It grants permission to your agent to act in your behalf to consider elective health care treatments, procedures or surgeries. This is a power you grant only when you are not able to act yourself.  (It takes over automatically and you can revoke it's power as soon as you recover)

If you are married, most would name their spouse for this duty. If you are single -- you can name whoever you trust the most to take over your health care decisions for you. But, again, remember you are putting your life or future well being in the hands of another -- so choose wisely.  You wouldn't want to give those powers to just anyone would you?

You don' t need to worry about emergency procedures to save or preserve your life. They will be provided to you in most cases without this instrument. The problem lies in the elective treatments, those procedures or surgeries the doctor or hospital recommends that are not dire emergencies. Before they can perform these health care services, they will need your "John Henry" on their release forms before they will proceed. If you can't sign, this document allows your agent to sign instead.

With a professionally prepared and signed Health Care Power of Attorney, the situation will not be exacerbated unnecessarily.  And, the stress of medical care scenarios will be lessoned so all attention can focus solely on your getting well again! Without this document at that critical time, your very health condition can be put on hold until such time permission can be properly granted by another caring for you.

Mental Health Care Power of Attorney (MHCPOA)
Mental Health Care

The newest health care document to enter our estate planning portfolio is the Mental Health Care Power of Attorney form. There is just one purpose: to preplan procedures and assign agents in charge -- in case your mental capacity falls below the legally acceptable criteria here in Arizona. Yes, there is some leeway for "senioritis" and temporary memory loss episodes. This form helps your loved ones to help you better if were ever to be considered "mentally ill" or "mentally incapacitated".

Without going into the specific tests that mental health care workers use to determine mental illness, suffice it so say that mental incapacity in any form can be devastating on a family member. But, with a MHCPOA, you can pre-plan your care and who choose who cares for you if you ever fall into this area of health care that so many fear. (throw away those aluminum pans!)   You can be ready if a mental deterioration illness does take place in your future.

Arizona Living Will (ALW)

Arizona Living WillThe modern Arizona Living Will contained in our Trust Portfolios protects against the situation of becoming terminally ill, or maybe even worse -- incurring significant mental incapacity in an otherwise healthy body.

We all could find ourselves in harms way in this manner and thus be caught in a coma we may never wake up from. Or to be awake but incur brain damage that would cause us to become disabled or even "brain dead".  Some say the worst "living hell" would be to be awake with greatly diminished mental capacity yet not die from such a situation.  (Life saving artificial means are automatic for health care workers unless you have properly rejected them by signing a Living Will prior to the event)

General Durable Power of Attorney (GDPOA)

Estate Assets Fund a TrustThe Arizona Durable General Power of Attorney instrument is a "money care" document.  It helps protect your money when you aren't able to make good, sound mental financial decisions.  If you are married, most would name their spouse for this duty. If you are single, you can name a child, relative, advisor or friend to serve.

But, remember this will result in the same procedure as handing your checkbook, debit card or credit cards to someone else and asking them to pay the bills and manage your money for you.  Of course, they are only "empowered" during the time you are disabled or unable to function mentally. You DO want to be cautious who you name as your agent for this document. You DON'T want to give these powers to just anyone unless you know they can do a good job for you.

What most don't understand is that this is one of the most important legal documents you can possess in the state of Arizona!  Without it, things can get out of control and expensive, very, very quickly!  You see if the court is made aware of your disability (financial institutions and their staff are required to report suspicious activity under the law), the control you so commonly assume you have when you are well is instantly transferred away from you under Arizona statutes!

Pour Over - Last Will & Testament  (POLWT)

Last Will & TestamentThe Pour Over Last Will & Testament we use with a modern Arizona living trust portfolio is in the same format as any other Last Will. The main difference is that the instrument is normally just a few pages, since almost all of the terms and conditions relating to your estate are contained in your trust document. In other words, the assets the Will will actually control in most cases, will be only very small bank accounts or low valued personal property such as an older car, etc.

Being careful not to exceed the Arizona $75,000 limit on personal property and $100,000 limit on real (your real estate) property, some chose to keep lower valued assets out of trust until death. At your death, anything kept out of the trust upon will "pour-in" at your death with this instrument, even if your estate is still required to go through probate. (which means either your financial advisor or you didn't properly fund your trust)

The POLWT also has a few other purposes beyond being a safety net for the trust estate that get legal in nature. You can rest assured that it is an important and necessary document that belongs in your trust portfolio.
